Microsoft is not recognized as a monopoly in the US. Next in line – Brussels
So, the multi-year saga with the investigation of the US antitrust committee against Microsoft ended in complete victory for Microsoft. Federal Judge Colleen Kollar-Kotelly released the findings of the investigation last Friday. According to this decision, the US Department of Justice and nine states have found the accusation of monopoly policy by Microsoft as groundless. In other words, the US has officially announced that Microsoft is not a monopoly.
What’s next? The next on the way of the software giant is the antimonopoly committee of the European Union. Towards the end of 2021, a special commission under this committee intends to make a preliminary decision on the results of an investigation into the dominance of Windows operating systems in Europe.
After receiving the news about the decision of the antitrust case in the United States in favor of the company, Microsoft representatives managed to express their opinion on a similar investigation in Europe. It became known that the company expects European lawyers to use the results of the investigation as a starting point. That is, as a legal precedent. However, I will not deal with casuistry, I would rather quote Horatio E. Gutierrez (Horacio E. Gutierrez), Microsoft’s Associate General Consultant in Europe: “From a legal point of view, (European Commission) is free to make any decision… however, we believe and hope that, in the interests of transatlantic consistency, it would be a balanced approach to consider known facts before making a decision.”
The position of the European authorities regarding the ongoing antitrust investigation has long been known, they have always stated that they will act in this matter without looking back at the US Department of Justice. One of the main complaints of the European Union against Microsoft is the integration of the Media Player into the Windows operating system, which harms competitors such as RealNetworks and Apple Computer.
Another serious accusation from Microsoft is that Windows is optimized for better performance with its own server hardware.
In short, news from Brussels promises to be interesting in the near future.
